L.T. PIVER is a company specialized in the creation, production, and marketing of perfumes and cosmetics under the L.T. PIVER brand, in France and internationally.
To complement its distribution network, L.T. PIVER offers a selection of its products for online sale via its official website:

ARTICLE 1 – GENERAL PROVISIONS

1.1 – Scope of Application

These General Terms and Conditions of Sale (hereinafter « GTCS ») define the rules applicable to any order placed on the Site, including:

  • Ordering procedures,
  • Payment,
  • Delivery,
  • Possible returns.

These GTCS apply to all sales of products made via the Site for deliveries in:

  • The European Union,
  • The United Kingdom.

The Customer acknowledges having read the GTCS before placing an order and expressly accepts its terms by checking the box « I accept the General Terms and Conditions of Sale » when validating the order.

This acceptance constitutes a binding commitment without restriction or reservation and excludes the application of any other terms, except by prior written agreement with L.T. PIVER.

The GTCS are available at any time on the Site and can be saved or printed by the Customer.

In the event of an update, the applicable GTCS are those in effect on the date of the order.
The Customer also declares that they:

  • Are acting as a consumer,
  • Are not purchasing L.T. PIVER products for commercial or resale purposes,
  • Have the legal capacity to contract.

For orders to countries not covered by L.T. PIVER, the Customer assumes the role of importer of the products.

1.2 – Acceptance of the GTCS

These GTCS apply to the exclusion of any other terms, including those in effect in other distribution or retail channels.
They are available on the Site and prevail over any contradictory document.
The Customer acknowledges being informed, before order validation, in a clear and understandable manner, of the information provided for in Article L221-5 of the French Consumer Code, notably:

  • Essential characteristics of the products,
  • Total price (products + delivery),
  • Delivery terms,
  • Seller identity (L.T. PIVER), business activity, and contact details,
  • Withdrawal rights and exercise procedures,
  • Applicable legal guarantees,
  • Conditions relating to the processing of personal data.

The GTCS may be modified at any time by L.T. PIVER. However, the applicable GTCS are those accepted at the time of the order.

Unless proven otherwise, data recorded by L.T. PIVER’s computer system constitutes proof of all transactions with the Customer.

Personal Data

In accordance with the French Data Protection Act of January 6, 1978, and the General Data Protection Regulation (GDPR No. 2016/679), the Customer has the following rights regarding their data:

  • Access,
  • Rectification,
  • Deletion,
  • Portability,
  • Objection.

ARTICLE 2 – PRODUCT INFORMATION

2.1 – Product Presentation

Products offered for sale on the Site are presented with the greatest possible accuracy, including:

  • Detailed descriptions,
  • Illustrations,
  • Sizes,
  • Compositions.

The Customer is invited to read this information carefully before placing an order. Product selection is the Customer’s sole responsibility.

2.2 – Illustrations and Display

Minor variations may appear between visuals (photos, illustrations) and delivered products due to:

  • Customer’s screen configuration,
  • Lighting or resolution.

These non-substantial differences do not constitute a defect or non-conformity and do not engage L.T. PIVER’s liability.
L.T. PIVER reserves the right to:

  • Correct any errors or omissions,
  • Update product information at any time, without notice.

2.3 – Product Availability

Product offers are valid while stocks last, as indicated at the time of order.

The Site offers a selection of products and does not constitute an exhaustive showcase of all L.T. PIVER items distributed.

ARTICLE 3 – ORDERS

3.1 – Product Selection by the Customer

The Customer may order products directly on the Site. They can create a customer account by completing a registration form. This account allows:

  • Managing personal information,
  • Tracking order history,
  • Accessing personalized services.

The Customer agrees to provide accurate information and keep it up to date. L.T. PIVER cannot be held responsible for delivery or billing errors due to incorrect or incomplete information.

Orders can also be placed as a guest, without creating an account.

The Customer selects products by clicking « Add to Cart ». They can view or modify the cart at any time by clicking the « Cart » icon at the top right of the Site.

Before finalizing the order, the Customer is invited to check order details: products, quantities, price, shipping costs, delivery, and billing addresses.

They can estimate shipping costs by entering the destination country and region.

The Customer then chooses the payment method, either:

  • As a guest (without an account),
  • By logging into their customer account.

After confirming the cart, the Customer enters payment details. Once payment is confirmed, a confirmation email is automatically sent.

The Customer expressly accepts email as the method for order confirmation.

3.2 – Formation of the Sales Contract

The order becomes final only:

  • After email confirmation of order acceptance by L.T. PIVER,
  • And after full payment is received.

If no confirmation email is received, the Customer should contact Customer Service:

Order validation constitutes the conclusion of a distance contract, subject to these GTCS.

3.3 – Order Tracking

For customers with an account, order tracking is available under « My Orders ».
The Customer can also track their parcel through emails sent by the carrier.

3.4 – Right to Refuse Orders

L.T. PIVER reserves the right to cancel any order:

  • In case of ongoing dispute with the Customer,
  • In case of non-payment (full or partial) of a previous order,
  • In case of obvious pricing errors (unreasonably low price),
  • In case of abnormal orders (excessive quantities, suspected commercial purchase).

L.T. PIVER only sells products to consumers or non-professionals for personal use.

3.5 – Order Cancellation by L.T. PIVER

L.T. PIVER reserves the right to refuse to ship:

  • Orders from suspicious email addresses,
  • Orders linked to invalid phone numbers.

3.6 – Payment

Payment is made exclusively by credit card at the time of order.

Accepted cards:

  • American Express
  • Carte Bleue
  • Visa
  • Mastercard

Payment is processed via a secure platform, with 3D Secure authentication, through a specialized provider (Cawl).

The Customer provides:

  • Card number,
  • Expiration date,
  • Security code (CVC).

They are then redirected to a secure page to validate payment with a 3D Secure code.

Once the transaction is validated, the Customer is redirected to the Site with order confirmation displayed.

ARTICLE 4 – PRICES

Prices displayed on the Site are expressed in euros (€) and vary depending on the destination country.

  • Prices include the applicable VAT for deliveries within the European Union.
  • Shipping costs are not included in product prices but are displayed before final order confirmation.

L.T. PIVER reserves the right to modify its prices at any time, particularly in case of:

  • Change in VAT rate,
  • Creation or modification of taxes, contributions, or eco-contributions.

The applicable price is the one displayed at the time of order, subject to product availability.produit.

ARTICLE 5 – DELIVERY

5.1 – Delivery Times

Products ordered are shipped from mainland France to countries within the European Union.
Zones de livraison exclues :
PO boxes, Northern Ireland, Canary Islands, Jersey, Guernsey, French overseas territories, Cyprus, Malta.

Available delivery methods:

  • DPD: mainland France, Monaco, European Union
  • Chronopost: United Kingdom, Switzerland

Delivery times are indicative and vary depending on:

  • Chosen carrier,
  • Destination country.

They include:

  • Order processing,
  • Transport to the address provided by the Customer.

For orders containing multiple items, delivery will be made in a single shipment unless otherwise specified.

The Customer will receive a confirmation email containing:

  • Proof of shipment,
  • A tracking number to track the parcel online.

If absent at the time of delivery, the Customer may:

  • Reschedule delivery,
  • Pick up the parcel at a collection point (according to carrier terms).

5.2 – Delays or Delivery Failures

L.T. PIVER commits to making every effort to meet the announced deadlines.

The deadline is considered met if the order is presented at the delivery address within the specified period.

If delivery does not occur within 30 days from the order, except in cases of force majeure or fault attributable to the Customer:

  • The Customer may request order cancellation in writing,
  • A full refund will be issued within 14 days, without penalty or additional compensation.

Reference Articles: L216-2, L216-3, and L241-4 of the Consumer Code.

5.3 – Shipping Costs

Shipping costs are not included in product prices and are added to the total order amount at checkout.

Shipping costs are calculated based on the destination country and the chosen shipping method, according to Colissimo rates.

For any order delivered within the European Union, the United Kingdom, and Switzerland with a total amount equal to or greater than 150€ including VAT, Relay Point delivery is free.

For orders to Switzerland and the United Kingdom, any customs duties and import taxes are the exclusive responsibility of the Customer.

ARTICLE 6 – LEGAL WARRANTIES

L.T. PIVER products are only covered by statutory warranties.

6.1 – Non-Conformity and Hidden Defects

L.T. PIVER takes the greatest care to ensure accurate product presentation and description on the Site (including photos, graphics, and previews) within technical and IT constraints and according to market standards. However, these presentations are for information purposes only and are not contractually binding.

In case of obvious non-conformity of the delivered product compared to its description on the Site (size, shape, or color significantly different from what was advertised), L.T. PIVER undertakes to correct the error. The consumer may either exercise their withdrawal right (Article 8) or invoke L.T. PIVER’s conformity guarantee, according to the legal provisions below

The Customer must verify the condition of delivered items. If an item is defective or non-conforming, it must be returned to L.T. PIVER for a refund of the item and shipping costs, if non-conformity or defect is proven.

The following are Articles L 211-4, L 211-5, L 211-12, L 211-13 of the French Consumer Code, and Articles 1641 and 1648(1) of the French Civil Code:
Article L 211-4 of the Consumer Code:
« The seller is required to deliver goods that conform to the contract and is liable for any non-conformity existing at the time of delivery. The seller is also liable for non-conformity resulting from packaging, assembly instructions, or installation when such installation was required by the contract or carried out under the seller’s responsibility. »
Article L 211-5 of the Consumer Code:
« To conform to the contract, the goods must:
1° Be suitable for the use normally expected of similar goods and, where applicable:

  • Match the description provided by the seller and possess the qualities presented to the buyer in the form of a sample or model;
  • Have the qualities that a buyer can reasonably expect in view of public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;

2° Or possess the characteristics defined by mutual agreement of the parties or be suitable for any special purpose sought by the buyer, brought to the seller’s attention and accepted by the seller.»

Article L 211-12 of the Consumer Code:
« The action resulting from non-conformity expires two years from the delivery of the goods.»
Article L 211-13 of the Consumer Code:
« The provisions of this section do not deprive the buyer of the right to bring an action for hidden defects as provided in Articles 1641 to 1649 of the Civil Code, or any other contractual or non-contractual action recognized by law. »
Article 1641 of the Civil Code:
« The seller is bound by the guarantee for hidden defects of the sold item which render it unfit for the use to which it is intended, or which so diminish that use that the buyer would not have acquired it, or would have paid a lower price, had they known of the defects.»
Article 1648, paragraph 1 of the Civil Code:
« The action resulting from hidden defects must be brought by the buyer within two years from the discovery of the defect.»

L.T. PIVER will reimburse or replace, at its expense and promptly, items proven defective or non-conforming by the Customer under Articles L217-4 et seq. of the Consumer Code.

6.2 – Warranty Exclusions and Limitations

If returned products do not correspond to the ordered products or originate elsewhere than the Site, L.T. PIVER is not bound by its obligations under Article 6.1.

L.T. PIVER’s warranty is, in any case, limited to replacement or refund of non-conforming or defective products.

ARTICLE 7 – TRANSFER OF OWNERSHIP AND RISKS

Ownership of L.T. PIVER products ordered via the Site is transferred to the Customer only after full payment, regardless of delivery date.

Risk of loss or damage transfers to the Customer upon physical receipt of the products.
The Customer assumes all risks and liabilities related to deterioration or loss of products from delivery onward, including during return shipping.

ARTICLE 8 – WITHDRAWAL RIGHT

8.1 – In accordance with Articles L221-18 to L221-28 of the Consumer Code, the Customer may withdraw from their order without reason within 14 days of receiving the product(s). In case of partial delivery, the withdrawal period begins upon receipt of the last item. If the 14th day falls on a Saturday, Sunday, or public holiday, the period extends to the next business day.

8.2 – The Customer must clearly express their intention to withdraw. They can use the following postal or email address: contact@piver.com.

8.3 – Each product must be returned in new condition, fully protected, and in its original packaging. L.T. PIVER will not refund products that do not correspond to the original order or originate from outside the Site.

Before returning products, the Customer may contact contact@piver.com to indicate the reason for the return and, if applicable, request a return label. The Customer must deposit the parcel at the chosen collection point. Refunds will be issued upon receipt of the product(s).

8.4 – Refunds, including shipping costs, will be credited to the original payment method. For partial returns, shipping costs are not refunded for retained products. Refunds occur within 14 days following (i) product return or (ii) proof of shipment, whichever is first.

ARTICLE 9 – AFTER-SALES SERVICE

Claims related to products ordered on the Site, including requests for exchanges, are handled exclusively via the Site’s after-sales service, which can be contacted at: contact@piver.com.

Resellers of the L.T. PIVER brand cannot be contacted for claims related to orders placed on the Site.

ARTICLE 10 – DATA PROTECTION

In accordance with French Law 78-17 of January 6, 1978, as amended by Law No. 2018-493 of June 20, 2018, and the EU General Data Protection Regulation (Regulation No. 2016/679), personal data requested from the Customer are necessary for order processing and invoice generation. These data may be shared with L.T. PIVER’s partners responsible for execution, processing, management, and payment of orders.

Data processing complies with legal requirements for personal data protection, and the information system used ensures optimal data security.

The Customer has, under national and European regulations, the right to permanent access, modification, rectification, objection, portability, and restriction of processing regarding their personal data. This right can be exercised under the conditions defined in L.T. PIVER’s privacy policy.

ARTICLE 11 – INTELLECTUAL PROPERTY

The Site’s content is the property of L.T. PIVER and its partners and is protected by French and international intellectual property laws.

Any direct or indirect reproduction, total or partial, is strictly prohibited and may constitute copyright infringement.

L.T. PIVER retains all intellectual property rights on videos, logos, photographs, presentations, studies, drawings, models, prototypes, etc., displayed on the Site.

Any reproduction or use, in whole or in part, for any purpose or medium, is prohibited without the express written prior authorization of L.T. PIVER, which may require financial compensation.

Creating hyperlinks to the Site or its pages/elements is also prohibited, as is any non-compliant use of the Site, including for commercial or professional purposes.

ARTICLE 12 – FORCE MAJEURE

L.T. PIVER cannot be held liable for non-performance or delay in performing obligations due to force majeure as defined in Article 1218 of the French Civil Code.

Execution of obligations by L.T. PIVER will be suspended in case of unforeseen or force majeure events that hinder or delay performance. Examples include, without limitation: war, riots, insurrection, social unrest, total or partial strikes, production or energy supply interruptions, and supply issues affecting L.T. PIVER.

L.T. PIVER will inform the Customer of such events within 14 days. If suspension continues beyond 15 days, the Customer may cancel the order, and a refund will be issued.

ARTICLE 13 – LIMITATION OF LIABILITY

L.T. PIVER is not liable for damages resulting from Internet use, such as data loss, intrusion, viruses, connection interruptions, or other issues beyond its control.

L.T. PIVER reserves the right to suspend the Site at any time.

L.T. PIVER has only an obligation of means. The Customer alone is responsible for determining the suitability of the ordered products. L.T. PIVER is not liable for misuse of products.

ARTICLE 14 – NON-WAIVER

L.T. PIVER’s failure to enforce any provision of these GTCS at any time cannot be interpreted as a waiver to later enforce full or partial compliance.

ARTICLE 15 – VALIDITY OF THE GTCS

If any provision of these GTCS is declared null or void, other provisions and related rights and obligations remain unchanged and applicable, provided their application is not rendered impossible.

ARTICLE 16 – APPLICABLE LAW AND DISPUTES

These GTCS and related transactions are governed by French law.
The GTCS are drafted in French. In case of translation into other languages, the French text prevails in case of dispute.

The GTCS are subject to French law except for mandatory provisions arising from EU Regulation No. 593/2008 (Rome I) on the law applicable to contractual obligations.

Any dispute arising from interpretation or execution of the GTCS, failing an amicable agreement, will fall under the exclusive jurisdiction of French courts, except as governed by EU Regulation No. 44/2001 (Brussels I) regarding jurisdiction, recognition, and enforcement of civil and commercial judgments.

The Customer is informed they may seek mediation before legal action to resolve disputes amicably via CMAP (Paris Mediation and Arbitration Center), the consumer mediator relevant to L.T. PIVER.

In accordance with Articles L616-1 and R616-1 of the Consumer Code, L.T. PIVER has implemented a consumer mediation procedure. The selected mediation entity is: CNPMÉDIATION CONSOMMATION, 27, avenue de la Libération, 42400 Saint-Chamond, France.

The Customer is free to accept or refuse mediation and to accept or reject the solution proposed by the Mediator. If refused, the Customer may pursue legal action in French courts under applicable French procedural and consumer law. A written request must first be sent to L.T. PIVER Customer Service before contacting CNPM.
